Terms of Sale — Botach PD Buyback

Version 2026-10-18.2 · Effective 2026-10-18

Key terms

Please read these points before you pay. The full terms follow. If anything here seems to differ from them, the full terms control.

  • What you're buying. Your department's used duty firearm, as your department turned it in, sold "as is", with no warranty from Botach. See Condition and warranty.
  • Where it goes. Botach ships it only to a licensed firearms dealer (FFL) in the state where you live. You collect it there after you complete ATF Form 4473 and any background check the law requires.
  • When your card is charged. Your card is charged the full total when you place your order. The firearm ships later: within 30 days of your payment, usually within a few business days.
  • If the transfer isn't completed. The firearm comes back to Botach, and you get back everything you paid, less the actual cost of return shipping, up to $75. See Transfer refused or not completed.
  • Cancelling. You can cancel for a full refund until the firearm ships. If Botach cancels your order, you get a full refund. There is no restocking fee.
  • FFL fee. The receiving FFL may charge its own transfer fee, which you pay to the FFL. Botach doesn't charge one.
  • These terms control. For this order they replace the botach.com store's general final-sale, return, refund and restocking-fee policies.
  • Your card rights. Nothing in these terms limits your right to dispute a charge with your card issuer.

Who these terms are between

These terms apply when you buy a firearm through the Botach PD Buyback portal at buyback.botach.com. The seller is Botach, Inc. ("Botach", "we", "us"), a California corporation, 4855 W Harmon Ave, Las Vegas, NV 89103. You are the law-enforcement officer your department listed for that firearm.

Your department is not a party to this sale. It listed its retired duty firearms and the officers who carried them, but Botach is the seller and is responsible to you for this sale under these terms.

These terms, the order details shown when you review your order, and the statement you confirm under Who can buy are the whole agreement for your PD Buyback order. For this order they replace the botach.com store's general final-sale, return, refund and restocking-fee policies. If anything conflicts, these terms control.

Who can buy

  • Only the officer the department listed for a firearm can claim it, by entering its serial number and their last name.
  • When you pay, you confirm this statement:
“I’m the officer listed for this firearm, I’m 21 or older, I live in the state where my receiving FFL is, I can legally receive and possess this firearm, and I’ll complete ATF Form 4473 with the FFL, and any background check the law requires.”
  • You buy the firearm as a private person, not for your department. Being a law-enforcement officer doesn't change the federal and state rules for a personal purchase. The on-duty exception doesn't apply once the firearm is yours: for example, a qualifying protective order bars you from receiving it. A conviction for a misdemeanor crime of domestic violence bars you on or off duty.
  • The licensed dealer (FFL) that receives the firearm must check your identity and complete ATF Form 4473 with you, and any background check the law requires, before it transfers the firearm to you. In some states a state permit can take the place of the federal background check. If the transfer can't be completed, see Transfer refused or not completed.
  • You must live in the state where the receiving FFL is. Each buyback ships only to FFLs in the states it allows. If you have a question about this, contact us at buyback@botach.com before you pay.
  • You must also be allowed to buy, receive and own the firearm, and anything shipped with it, under the laws that apply where you live and where the FFL is: state, county and city. Examples are a permit or license to buy, a waiting period, registration, and limits on models or magazine capacity. The FFL can refuse a transfer that its law doesn't allow.
  • Each order is for one firearm. If your department listed more than one firearm for you, each is a separate claim and a separate order.

Your claim

  • When you confirm "This is my firearm", the firearm is held for you for 20 minutes, and each step you complete renews the hold. If the hold runs out, look the firearm up again to continue.
  • If your department set a deadline, the buyback closes at the end of that day, Pacific time (midnight Pacific is 2 a.m. Central time the next morning). After it closes, the firearm can no longer be claimed through the portal. The buyback can also close earlier if your department ends it.
  • Your full legal name must match the ID you show the FFL.

How your order is placed

Your order is placed when Botach has confirmed your payment with Authorize.net, after any fraud review. We then show your order number and email your order confirmation.

Before your firearm ships, we may cancel your order only if:

  • the price, model or serial number shown to you was clearly wrong because of an error;
  • your department withdraws the firearm (for example, because it is lost, damaged or needed as evidence);
  • the receiving FFL's license is no longer valid, and we can't arrange another FFL with you; or
  • we reasonably believe the sale would break the law, or the claim wasn't made by the officer listed for the firearm.

If we cancel, Botach staff will email you and refund everything you paid to your card within 7 business days. We never ask you to pay more for an order already placed.

Price, shipping and tax

  • Each firearm's price is set for the buyback, by Botach or from your department's list, and shown before you confirm.
  • Shipping to the FFL is charged once per order, as shown before you pay: free, a standard amount, or an amount set for the buyback. Where the buyback lets you use your own FFL for a fee, that fee replaces shipping.
  • Sales tax is calculated by Botach's online store from the address the firearm is shipped to, which is the receiving FFL's address. You see the exact total (price, shipping, tax and any other charge listed) before you pay.
  • The total you see before you pay is everything Botach charges you for this order. All amounts are in US dollars.
  • The receiving FFL may charge its own transfer fee, which you pay to the FFL. Botach doesn't charge one.

Payment

  • You pay by card in Authorize.net's secure payment form. Botach never sees or stores your card number.
  • When your card is charged. Your card is charged the full total when you place your order. Botach ships the firearm to the FFL later, within the time stated under Shipping to the FFL. By paying, you agree to that later delivery.
  • Your order is recorded as paid only after Botach has checked the payment with Authorize.net. A payment held for fraud review is not complete until it is approved.
  • If your card is declined, you can try again or use a different card while your hold lasts.
  • Questions about a charge. If something looks wrong, email buyback@botach.com first, and we'll try to fix it quickly. Nothing in these terms limits any right you have to dispute a charge with your card issuer.

Shipping to the FFL

  • Botach ships the firearm only to the FFL shown when you review your order. That is either the FFL your department's buyback uses or, where the buyback allows it, an FFL you chose.
  • If you choose the FFL, call it first to confirm that it accepts firearms shipped from another dealer, and ask about its transfer fee. An FFL doesn't have to accept a transfer.
  • Botach checks that the FFL's license is active before your order is placed. If the license is later found not to be valid, we'll contact you to arrange another FFL or cancel your order for a full refund.
  • Each order is one firearm and ships in one shipment.
  • We ship within 30 days of your payment, usually within a few business days, by a firearms-approved carrier (UPS or FedEx) with an adult signature at the FFL. "Ship" means we hand it to the carrier. We email you when it ships.
  • If we can't ship within 30 days, Botach staff will email you and offer a full refund.
  • If the firearm hasn't reached the FFL 10 business days after we email you that it shipped, contact us at buyback@botach.com.
  • Ownership and risk of loss pass to you when the FFL transfers the firearm to you. Until then the firearm stays Botach's property, at Botach's risk.

Transfer refused or not completed

The FFL decides whether it can lawfully transfer the firearm to you. Botach can't change or speed up its decision or a background check.

If the transfer isn't completed, the FFL returns the firearm to Botach. This applies, for example, if:

  • the background check is denied or delayed, and the FFL doesn't transfer the firearm to you;
  • the FFL finds you can't lawfully receive the firearm;
  • the FFL won't accept or transfer the firearm for its own reasons;
  • you don't collect the firearm within 30 days after the FFL tells you it has arrived, and after Botach staff have emailed you twice.

If the transfer was refused because you may not lawfully receive the firearm, Botach won't send it to you, to another person or to another FFL on your behalf. If you think a background-check denial was a mistake, you can ask the agency that ran the check for the reason and appeal it.

Botach never sends the firearm to you directly, or to anyone but a licensed dealer.

What you get back: everything you paid (price, shipping and tax), less the actual cost of shipping the firearm back to Botach, up to $75. There is no restocking fee. We send the refund to the card you paid with within 7 business days after the firearm is back with Botach.

Cancellations and refunds

  • You can cancel your order for a full refund at any time before the firearm ships: email buyback@botach.com with your order number.
  • If Botach cancels your order, you get a full refund.
  • Once the firearm has shipped, you can't cancel. If the transfer then isn't completed, you get the refund described under Transfer refused or not completed. After the FFL transfers the firearm to you, the sale is final, except as stated under Condition and warranty or where the law gives you more rights.
  • The botach.com store's final-sale, return and restocking-fee policies don't apply to this order. There is no restocking fee.
  • Refunds go back to the card you paid with, within 7 business days after Botach decides on the refund or after the firearm is back with Botach. Botach staff will email you the date we sent each refund and its amount. Your card issuer may take a few more days to post it.

Condition and warranty

It comes as your department turned it in: a used duty firearm, with only the magazines and accessories the department included. It shows the wear of duty use.

Anything we tell you about the firearm's service history comes from your department's records. Botach hasn't checked it.

Have the firearm inspected by a qualified gunsmith before you fire it.

If the firearm isn't the one on your order (a different model or serial number), or was damaged before it reached the FFL, you may refuse it at the FFL. Tell the FFL and email us. We'll send the right firearm if we can, or refund everything you paid.

SOLD "AS IS" — NO IMPLIED WARRANTIES. BOTACH SELLS THE FIREARM "AS IS" AND "WITH ALL FAULTS". THE ENTIRE RISK AS TO ITS QUALITY AND PERFORMANCE IS WITH YOU, AND IF IT NEEDS SERVICE OR REPAIR, YOU PAY FOR IT. BOTACH GIVES NO WARRANTY OF ITS OWN AND DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.

Any manufacturer's warranty is the manufacturer's, not Botach's. Botach doesn't adopt or extend it. Whether it covers a used department firearm is up to the manufacturer.

Your responsibilities with the firearm

After the FFL transfers the firearm to you, you're responsible for handling, storing, carrying, transporting and using it safely and lawfully, including following the laws of your state and city.

Accurate information

You agree that the information you give us is true and complete.

Limits on our liability

TO THE EXTENT THE LAW ALLOWS: (1) BOTACH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM THIS SALE, SUCH AS LOST TIME OR TRAVEL COSTS; AND (2) BOTACH'S TOTAL LIABILITY FOR ANY CLAIM ABOUT YOUR ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR IT.

These limits don't apply to death or personal injury, to fraud or intentional misconduct, or to any right the law doesn't allow to be limited. Nothing in these terms limits your rights under the Texas Deceptive Trade Practices–Consumer Protection Act or any other consumer protection law that can't be waived.

Questions and disputes

  • If something goes wrong, email buyback@botach.com first. Tell us your order number and what you'd like us to do.
  • These terms are governed by federal law and the laws of the state where you live.
  • You may bring a claim in any court that has jurisdiction, including a small-claims court. There is no arbitration clause and no class-action waiver in these terms.
  • Send any written notice, including a notice the law requires before a lawsuit, to Botach, Inc., 4855 W Harmon Ave, Las Vegas, NV 89103, and email a copy to buyback@botach.com.

Privacy

Our Privacy Policy explains what information we collect, why, who we share it with, how long we keep it and your rights. You don't have to agree to it to have those rights.

Electronic records

You agree to receive these terms, your order confirmation, receipts and notices about your order electronically, at the email address you give us. Ticking the box at checkout is your electronic signature. You can print or save these terms, and we'll email you a copy of the version you accepted, free, if you ask.

General

  • If a court finds part of these terms unenforceable, the rest still applies.
  • If we don't enforce a term right away, we can still enforce it later.
  • Botach may transfer this agreement to a business that takes over the PD Buyback program, and your rights under it stay the same.
  • Neither of us is responsible for a delay caused by events outside our reasonable control, such as carrier disruption, severe weather or a background-check system outage. This never delays a refund you're owed, or our duty to tell you about a shipping delay and offer a refund.

Changes and your acceptance

At checkout you tick one box before you pay. Ticking it accepts these terms and the statement under Who can buy, and confirms you've read the Privacy Policy. We record the version of each document you accepted and when. If these terms change later, the version you accepted applies to your order.
